Cet ouvrage rend hommage au Professeur Claude JOURNÈS, ancien Président de l'Université LUMIERE Lyon 2 et membre fondateur du mouvement Critique du droit. Les Mélanges offerts au Professeur Claude JOURNÈS ont retenu cette approche, utilisant le droit comme un outil de mise en perspective critique de l'ordre social et de l'ordre politique. Après un hommage au Doyen JOURNÉES (P. BLACHÈR) et l'évocation des ambitions et perspectives du mouvement critique Du droit (S. BASSET ou J. MICHEL), l'ouvrage se construit en deux (...) temps. La première partie, intitulée « Le droit critique de l'ordre social », regroupe des réflexions sur le pouvoir médical (F. DEMICHEL), sur les crimes coloniaux (A. MAHIOU), sur la dimension anthropologique du vocabulaire juridique (M.-C. HATTI) et sur le contrôle policier (M. SAOUDI), le tout ouvrant sur la possibilité d'un humanisme séculier (H. PUEL). La seconde partie, « Le droit critique de l'ordre politique », entend montrer comment le droit porte en lui une conception du pouvoir et de l'autorité. Les études explorent des pistes très diverses mêlant les finances publiques (J.-L. ALBERT), les renseignements (C. ARROUDJ), l'histoire du droit (J.-L. AUTIN, J.-C GENIN), l'histoire de la doctrine (H. GOURDON), les institutions politiques (P. BACOT, A.-S. MESCHERIAKOFF, R. CHARVIN), les institutions territoriales (J.-J. GLEUAL, H. OBERDORFF, R. PAVRE), la littérature (S. CAPORAL, G. HARE) ou les nouvelles technologies (G. PROTIÉRE). II ressort de l'ensemble que, loin d'être un simple outil technique, le droit est un puissant instrument de modélisation sociale et de justification du pouvoir. Inversant la logique dominante, la perspective critique du droit dévoile les limites d'une telle conception et rappelle que le droit, comme tous les construits sociaux, est le produit de luttes politiques et de rapports de force. This conference was devoted to the 80 years of the Copenhagen Interpretation, and to the question of the relevance of the Copenhagen interpretation for the present understanding of quantum mechanics. It is in this framework that fundamental questions raised by quantum mechanics, especially in information theory, were discussed throughout the conference. As has become customary in our series of conference in Växjö, we were glad to welcome a fruitful assembly of theoretical physicists, experimentalists, mathematicians and even philosophers interested in the (...) foundations of probability and physics. The nature of quantum fluctuations---in the form of Stochastic Electrodynamics or in other approaches to stochastic quantum mechanics---was also a central topic discussed during the conference, especially during debates. We should also mention talks on the completeness or incompleteness of quantum mechanics; on macroscopic quantum systems; on Bell's inequality, entanglement and experiments on quantum nonlocality (and locality); on Bohmian mechanics; on the connection between quantum mechanics and general relativity; on quantum probability; on quantum computing, quantum teleportation and quantum cryptography technologies; and more generally on the mathematical formalism of quantum mechanics and on the philosophical problems raised by its interpretations. The first step of the construction of Nézondet's models of finite arithmetics which are counter-models to Erdös–Woods conjecture is to add to the natural numbers the non-standard numbers generated by one of them, using addition, multiplication and divisions by a natural factor allowed in an ultrapower construction. After a review of some properties of such a structure, we show that the choice of the ultrafilter can be managed, using just the Chinese remainder's theorem, so that a model as desired is (...) obtained as early as at the first time. _A portrait of Martin Heidegger as a man and a philosopher_ In this biography of Martin Heidegger (1889–1976), now available in English, historian Guillaume Payen synthesizes the connections between the German philosopher’s life and work. Critically, but without polemics, he creates a portrait of Heidegger in his time, using all available sources—lectures, letters, and the notorious “black notebooks.” Payen chronicles Heidegger’s “changing destinies”: after the First World War, an uncompromising Catholicism gave way to a vigorous striving for a philosophical (...) revolution—fertile ground for National Socialism. The book reflects a life of light and shadow. Heidegger was a great philosopher and teacher who cultivated friendships and love affairs with Jews but also was an anti-Semitic nationalist who lamented the “Judaization of German intellectual life.”. While Deleuze and Guattari's Anti-Oedipus is quite rightly considered a fully fledged response to May ’68 and as one with the radical politics of the 1970s, their 1980 follow-up, A Thousand Plateaus, has tended to provoke a more perplexed reaction. In this article, I will argue that we can nonetheless extract a definite line of argumentation serving a precise political end if we relate the text back to Foucault's mid-1970s output on power/knowledge. In particular, I will emphasise Deleuze and Guattari's (...) appropriation of the Foucaultian notion of dispositif via their concept of the assemblage, the former being understood as a concrete articulation of lines of power, knowledge and subjectivation, as well as the Foucaultian ‘diagram’, the latter being a more abstract or indeterminate stage of the dispositif whose relative indeterminacy, for Deleuze and Guattari, offers a means of escape. I will show that, making room for the assemblage's opening back onto the relative indeterminacy of its generative stages, the assemblage incorporates into itself a more immanent alternative to the dispositif that is focused on collective desire rather than power, within which resistance becomes a primary and generative dimension rather than a counter-attack. In the first section, I will outline Foucault's approach to power, knowledge and subjectivation, emphasising Deleuze's reading of Foucault though without trying to overdetermine my reading in this way. Next, I will turn to the Foucaultian diagram. In the third section, I will focus on A Thousand Plateaus, demonstrating how the notion of assemblage developed in this text responds to and builds upon Foucault's approach to power/knowledge and subjectivation in order to reconceive resistance. Why did Thomas More write two versions of his History of King Richard III, one in English and the other in Latin? Critics tend to answer this question by arguing that the two versions were not destined for the same audience: the Latin for a continental elite, the vernacular for a larger British readership. Although perfectly convincing, this explanation may not be the only one: this paper tries to underline the existence of another motivation, one of a literary nature. The (...) History of King Richard III indeed combines two historiographical models: the ancient and classical monograph as illustrated by Sallust, and the medieval tradition of the chronicle. The oscillation between English and Latin may reflect More's wish to renovate the genre of the medieval chronicle, accomplished by an hybridization with classical Latin models—as if More attempted to grasp the best of both traditions in order to initiate a new means of writing history. Guillaume Collett questions to what extent we can locate Deleuze within the Lacanian School during the late-1960s, prior to Guattari. In so doing, he offers a new, integrated reading of Deleuze's The Logic of Sense by understanding it as a 'psychoanalysis of sense', and gives a new interpretation of Deleuze's conception of philosophy itself. The Psychoanalysis of Sense shows that Deleuze was not merely aware of the debates animating the Lacanian School during the 1960s: he sought to contribute to (...) them. Emphasising his appropriation of the work of post-Lacanian Serge Leclaire, Collett explains how Deleuze constructed a more singular and immanent theory of the linguistic structure of the unconscious - granting the erogenous body a larger structuring role. La réflexion philosophique, dont l'ouverture à l'univers dans lequel nous nous découvrons - avec une acuité proportionnelle à un étonnement renouvelé - n'a pas de limites, n'en est que plus tributaire des sciences et des techniques, des arts et de multiples activités qui régissent plus ou moins fructueusement notre expérience. Or, au sein des sciences humaines, privilégiées pour éclairer une condition que nous ne saurions cesser d'interpréter, peu d'oeuvres du dernier siècle auront enrichi en le précisant notre être-au-monde, comme la (...) théorie linguistique de Gustave Guillaume, assez solitaire, et les recherches multiformes de Jean Piaget - où la psychologie de l'enfant a souvent occulté la visée épistémologique et son enracinement biologique (cf Biologie et connaissance, 1967) et ses prolongements pédagogiques, voire éthiques. Le Cinquantenaire et le Trentenaire de leur disparition appelaient un hommage d'autant plus impératif qu'ils sont restés marginaux ou ignorés dans les milieux philosophiques, malgré la centralité de leurs élucidations. Leur commune orientation génétique et structurale n'ayant suscité aucun échange, pendant la contemporanéité de publications d'un tiers de siècle (1923-1960), mesurer leur complémentarité s'impose d'autant plus. S'ils peuvent aider à repenser la condition humaine, c'est qu'ils auront contribué à dissiper le "mystère de la pensée". L'un cherchant à habiliter les caractères systématique et cinétique des langues, irremplaçables moyens de penser ; l'autre dans un vis-à-vis cognitif et opératoire de Freud, en relavant sur les plans épistémologique et logique, notamment, l'élan révolutionnaire de la seconde modernité, autour de l'évolutionnisme. Mais les thèmes majeurs du constructivisme, du schème et de la symbolisation - et plus largement du temps et du langage - auront sans doute aidé à spécifier les mutations autorisées par la révolution critique. Entre l'Instant du je parle et un décentrement exigible pratiquement (éthique) comme théoriquement (épistémique), c'est bien la condition humaine dans son ensemble qui est concernée. Si repenser cette Condition s'impose en permanence, il importe de ne pas manquer des oeuvres qui, par-delà toute mode, proposent à notre expérience des fondations résistant à d'inéluctables vicissitudes. O filósofo se afasta da longa tradição alemã dos hinos à melancolia, ao mesmo tempo em que subverteu os poemas filosóficos - os darwinistas em particular - de sua época, para superar seu pessimismo schopenhaueriano.The article aims at describing the poem “An die Melancholie” as an essential and crucial (...) moment within the development of Nietzsche’s philosophy, which refers to the first intuition of the notion of “Will to Power”. The philosopher deviates from the long German tradition of odes to melancholy, whilst subverting the philosophical poems of his own time - specially the Darwinian ones -, in order to overcome his Schopenhauerian pessimism. The confrontations of stakeholder visions about agriculture and food production has become a focal point in the public sphere, coinciding with a diversification of agrifood models. This study analyzes the debates stemming from the coexistence of these models, particularly during the initial term of neoliberal-centrist Emmanuel Macron’s presidency in France. Employing collective monitoring from 2017 to 2021, a corpus of 958 online news and blog articles was compiled. Using a computational analysis, we reveal the framings and controversies emerging from this (...) media discourse. The macro-structuring of discourse on model coexistence revolves around scientific, economic and political framings. Coexistence is a complex of debates based on specific frames associated with specific arenas and actor configurations: growth of organic agriculture, transformations of agrifood systems, sciences of production and impacts, livestock and meat diet controversies, agroecological innovations, CAP reform criticism, discourse of peasant agriculture and State-Profession _co-gestion_. Employing global sentiment analysis and focusing on salient controversies, namely EGAlim law, pesticide regulations, and agribashing, we show the shift from conciliation to a hardening of debates. Finally, we discuss the causes and consequences of this trend. The political will to support the transition of agriculture remains influenced by the _co-gestion_ system, an inherited configuration of decision-makers instrumental in the agricultural modernization. As a consequence, significant agricultural challenges, particularly highlighted in the scientific macro-frame, persist unresolved. This lock-in of the agrifood system is based on defensive strategies that challenge the democratic debate about food and agricultural practices. (shrink)

Unlike in physics, the category of thought experiment is not very common in biology. At least there are no classic examples that are as important and as well-known as the most famous thought experiments in physics, such as Galileo’s, Maxwell’s or Einstein’s. The reasons for this are far from obvious; maybe it has to do with the fact that modern biology for the most part sees itself as a thoroughly empirical discipline that engages either in real natural history or in (...) experimenting on real organisms rather than fictive ones. While theoretical biology does exist and is recognized as part of biology, its role within biology appears to be more marginal than the role of theoretical physics within physics. It could be that this marginality of theory also affects thought experiments as sources of theoretical knowledge. Of course, none of this provides a sufficient reason for thinking that thought experiments are really unimportant in biology. It is quite possible that the common perception of this matter is wrong and that there are important theoretical considerations in biology, past or present, that deserve the title of thought experiment just as much as the standard examples from physics. Some such considerations may even be widely known and considered to be important, but were not recognized as thought experiments. In fact, as we shall see, there are reasons for thinking that what is arguably the single most important biological work ever, Charles Darwin’s On the Origin of Species, contains a number of thought experiments. There are also more recent examples both in evolutionary and non-evolutionary biology, as we will show. Part of the problem in identifying positive examples in the history of biology is the lack of agreement as to what exactly a thought experiment is. Even worse, there may not be more than a family resemblance that unifies this epistemic category. We take it that classical thought experiments show the following characteristics: They serve directly or indirectly in the non-empirical epistemic evaluation of theoretical propositions, explanations or hypotheses. Thought experiments somehow appeal to the imagination. They involve hypothetical scenarios, which may or may not be fictive. In other words, thought experiments suppose that certain states of affairs hold and then try to intuit what would happen in a world where these suppositions are true. We want to examine in the following sections if there are episodes in the history of biology that satisfy these criteria. As we will show, there are a few episodes that might satisfy all three of these criteria, and many more if the imagination criterion is dropped or understood in a lose sense. In any case, this criterion is somewhat vague in the first place, unless a specific account of the imagination is presupposed. There will also be issues as to what exactly “non-empirical” means. In general, for the sake of discussion we propose to understand the term “thought experiment” here in a broad rather than a narrow sense here. We would rather be guilty of having too wide a conception of thought experiment than of missing a whole range of really interesting examples. (shrink)

Bernard Bolzano (1781–1848) is commonly thought to have attempted to develop a theory of size for infinite collections that follows the so-called part–whole principle, according to which the whole is always greater than any of its proper parts. In this paper, we develop a novel interpretation of Bolzano’s mature theory of the infinite and show that, contrary to mainstream interpretations, it is best understood as a theory of infinite sums. Our formal results show that Bolzano’s infinite sums can be equipped (...) with the rich and original structure of a non-commutative ordered ring, and that Bolzano’s views on the mathematical infinite are, after all, consistent. On a souvent accusé Hegel de ne pas arriver à dire ce qu’il voulait dire. Notre hypothèse est que l’obscurité du dire hégélien tient en grande partie à une volonté délibérée de ne pas réduire la complexité des choses à un savoir de surface, de façon à obliger le lecteur à assimiler le sens qui se cache derrière les représentations bien connues. Pour étayer notre hypothèse, nous montrons comment le dire et le vouloir se nouent dans l’écriture du système hégélien (...) aussi bien dans sa mouture phénoménologique que dans sa mouture encyclopédique. Par ce biais, il s’agit de clarifier à la fois le problème de l’instanciation du système hégélien et celui de sa finalité, laquelle n’est autre que celle d’une philosophie qui se veut institution du sens. How do we individuate the senses, what exactly do we do when we do so, and why does it matter? In the following article, I propose a general answer to these related questions based on Franz Brentano's views on the senses. After a short survey of various answers offered in the recent literature on the senses, I distinguish between two major ways of answering this question, causally and descriptively, arguing that only answers giving priority to description and to the classification (...) involved in it are on the right track for a general answer to the related questions. In the second part of the article, I argue that Brentano's descriptive psychology is an attractive candidate for such an answer. His descriptive psychology provides a plausible account of the classification involved in description, in particular regarding the classification of sensory qualities. I close the article by briefly explaining how Brentano spells out the priority of descriptive answers over causal ones. (shrink)

Le spiritualisme ravaissonien ouvre l'horizon d'une refondation complète de la métaphysique au cœur du XIXe siècle français. À partir de la lecture d'Aristote, Ravaisson élabore une critique de ce que l'on peut nommer les 'métaphysiques de la séparation', dont le point de départ se trouve dans les écrits du stagirite. Il s'agira dès lors de déployer une philosophie qui affirme l'identité de l'être et de la pensée, par-delà toute transcendance et tout dualisme. In update logic as studied by Baltag, Moss, Solecki and van Benthem, little attention is paid to the interpretation of an action by an agent, which is just assumed to depend on the situation. This is actually a complex issue that nevertheless complies to some logical dynamics. In this paper, we tackle this topic. We also deal with actions that change propositional facts of the situation. In parallel, we propose a formalism to accurately represent an agent's epistemic state based on (...) hyperreal numbers. In that respect, we use infinitesimals to express what would surprise the agents (and by how much) by contradicting their beliefs. We also use a subjective probability to model the notion of belief. It turns out that our probabilistic update mechanism satisfies the AGM postulates of belief revision. (shrink)

This study examines to what extent different types of CEOs in family firms influence external and internal stakeholder-related CSP as compared to CEOs in nonfamily firms. Linking family CEO and nonfamily CEO with CSR outcomes, we provide evidence that family CEOs are positively associated with both external and internal CSR, whereas nonfamily CEOs within family firms tend to be negatively associated with both external and internal CSR. We show that the incumbent CEO’s age moderates the above relationships, indicating the existence (...) of shifting family priorities and suggesting a tendency toward CSR conformity as the salience of succession concerns increases. The Covid-19 pandemic has affected not only the health of populations but also their everyday social practices, transformed by orienting to risks of contagion and to health prevention discourses. This paper emanates from a project investigating the impact of Covid-19 on human sociality and more particularly the situated and embodied organization of social interactions. It discusses how Covid-19 impacts the design of ordinary actions in social interaction, how this is made publicly accountable by the participants orienting to the pandemic in (...) formatting their actions and in responding to the actions of others. Adopting an ethnomethodological and conversation analytic perspective, the analyses focus on a particular social activity: paying. The organization of payments in shops and services has been affected by the pandemic, not only by official regulations, favoring some modes of payment over others, but also in how sellers and customers situatedly adapt their practices to imperatives of prevention. On the basis of a rich corpus of video-recorded data, which spans from the pandemic’s prodromes to and after its peak, we show how money transfer is methodically achieved – imposed, negotiated, and readjusted – while variously taking into account possible risks of contagion. Thus, we show not only how pandemics affect social interaction, and how prevention is incarnated in social actions, but also how, in turn, situated solutions implemented by people during the pandemic reveal fundamental features of human action. In this paper, we examine Sextus Empiricus' treatise Against the geometers . We first set this treatise in the overall context of the sceptic's polemics against the liberal arts. After a discussion of Sextus' attitude to the quadrivium , we discuss the structure, the sources and the target of the Against the geometers . It appears that Euclid is not Sextus' source, and neither he, nor the professional geometers, seem to be Sextus' main targets. Of course, Sextus never really makes (...) clear his precise target, but his attacks are rather directed against geometry as a means of modelling the physical world, thus ruining the support geometry was intended to bring to the physical part of dogmatic philosophy. The development of phenomenology in nineteenth‐century German philosophy is that of a particular stream within the larger historical‐philosophical complex of Austro‐German philosophy. As the “grandfather of phenomenology” resp. the “disgusted grandfather of phenomenology,” but also as the key figure on the “Anglo‐Austrian Analytic Axis”, Brentano is at the source of the two main philosophical traditions in twentieth‐century philosophy. This chapter focuses mainly on his place in nineteenth‐century European philosophy and on the central themes and concepts in his philosophy that were (...) determinant in the development of the philosophy of his most gifted student: Edmund Husserl. Despite the variety of stances which Brentano expressed on ontology, metaphysics, and psychology over the course of his career, the five general principles remain central to his whole philosophy throughout: they have an important place in what could be called Brentano's philosophical worldview or system. Considers Deleuze's ideas on philosophical practice in relation to his work. This book presents analyses of, and aims to provide some context for, this relation in Deleuze's work, by focusing on Deleuze's conception of the relation between thought and practice, the brain and the hand (or mouth).

Phenomenological accounts of self-consciousness are often said to combine two elements by means of a necessary connection: the primitive and irre- ducible subjective character of experiences and the idealist transcendental constitution of consciousness. In what follows I argue that this connection is not necessary in order for an account of self-consciousness to be phenomenological, as shown by early phenomenological accounts of self- consciousness – particularly in Munich phenomenology. First of all, I show that the account of self-consciousness defended by these (...) phenomenologists was not influenced as much by Husserl as by two important figures in the prehistory of phenomenology: their teacher Theodor Lipps, and – indi- rectly, through Lipps’ influence – Hermann Lotze. Second, I show that their account of self-consciousness takes the metaphysical realism underlying Lotze’s and Lipps’ views on the distinction between feeling and sensations seriously. I argue that this distinction played a central role in the development of many early phenomenological accounts of self-consciousness. (shrink)
